The IR35 contractor news today is that Dominic Cummings is the sole director of a company called Dynamic Maps Limited. The declared nature of the business is Information Technology Consultancy Activities. So, Boris Johnson’s guru, Dominic Cummings is an IT contractor like many of the rest of us.

What is Dominic Cummings IT Consultancy Company

Dominic Cummings limited company, Dynamic Maps, was set up in October 2017 and its last accounts were in October 2018. The next accounts are due in October 2020.

The Net Worth of the company is £78,800 with Total Current Assets of £102,900 and Total Current Liabilities of £25,800.

He is a director of only one other company and that is Klute Limited where he is down as a Political advisor. He became a Director of it in December 2010.

It has Total Assets of £1 and Total Liabilities of £0 with £1 cash in the bank. As a non-Accountant that looks a bit funny after 9 years trading but I don’t know what it means.

So, Dominic has been a Political Advisor for 9 years. However, it is only a couple of years ago that he expanded into IT consultancy.

Is Dominic Cummings Caught by IR35

So, could Dominic Cummings, the 2nd most powerful man in the land, be inside IR35?

Having two sources of income doesn’t take you outside IR35. There was the case of the doctor whose main contract was with the NHS. He also had a smaller contract with a private hospital.

The IR35 Employment Tribunal found him inside IR35 on his main contract, the NHS one, and outside IR35 on his smaller contract.

The doctor is appealing this. He represented himself in the original one and has crowdfunded about £25,000 for his appeal.

However, as it stands, you can be inside IR35 on one contract and outside in another.

Going by this example, one would think that political advising is his main contract and the mysterious IT Consultancy activities the smaller one.

So, he would be more likely to be inside IR35 in his Political Consultancy contract.

One presumes he now freelances to the Government now rather than privately to Boris Johnson’s campaign.

Has he undergone an IR35 test as a public sector freelancer

Has he undergone an IR35 test as a public sector worker? Is his IT Consultancy business for the Government or for the private sector?

One wonders how he would answer some of the questions in HMRC’s Check Employment Status for Tax test (CEST).

How does he answer the Supervision, Direction and Control questions

Parliament might be interested to know how he answered the questions on Supervision, Direction and Control. Sajid Javid might be interested in that one too.

Is there a Mutuality of Obligation here between Boris Johnson and Dominic Cummings?

Does he have the Right of Substitution in his contract? Is that person named? Is Dominic Cummings the type of person who believes that someone could substitute for him?

It would be very interesting if someone au fait with IR35 and the CEST test were to put Dominic Cummings’s details through it.

It would be even more interesting if one of those companies who made all their contractors sit the test and failed them were to put Dominic’s details through it. Would even he pass the test then?

Is there IR35 contractor news of another freelancer in Government

Of course, we have another freelancer high up in Government. This is a freelance journalist with a column in the Telegraph and elsewhere. Even though Boris Johson is now Prime minister one presumes that company is still active.

So, that means that the two most powerful men in the land are freelancers – with one of them an IT Consultant.

There was great hope that Sajid Javid would be a freelancer’s friend. After all he was an avid user of freelancers in his last job as Managing Director of Deutsche Bank. He even said in those days that the Government should ‘repeal the silly IR35 tax’.

However, in the end he was a permanent employee who used freelancers rather than being a freelancer himself.

Will Freelancers Boris Johnson and Dominic Cummings be Freelancer Friendly

Contractors are always complaining that they have very little representation in Parliament. They say that MPs. who are permanent employees, don’t understand them and their problems with IR35.

Well, now the two most powerful men in the land are both freelancers just like us – and they both must understand IR35 and the problems raised by it.

So, will two freelancers running the country be beneficial to contractors?

As nobody running the country has ever been beneficial to contractors, I know what most contractors would say to that one.

However, knowing the type of person Dominic Cummings is, i.e. a think out of the box person, and knowing the kind of staid organisation HMRC is, one would not expect him to be a big fan of theirs.

But it puts an interesting slant on the Government and the looming IR35 crisis.

Previous Prime Ministers and Chancellors like David Cameron, Theresa May, George Osborne and Philip Hammond were very staid characters all of whom were permanent employees. They were all Roundheads you might say. Boris Jonson and Dominic Cummings are both Cavaliers.

Having those two running the country will probably make no difference at all to contractors and IR35.

However, you never know!

What UK Directorships have Boris Johnson and Rishi Sunak had

PS I can’t find any company that had Boris Johnson as a Director. So how did he channel his earnings from freelance journalism – like his weekly column in the Daily Telegraph?

PS the only company that I can find where Rishi Sunak was a Director was Catamaran Ventures UK. He was appointed Director in 2013 and resigned in 2015 before entering Parliament in 2017.

According to Gov UK:-

” Rishi spent his professional career before politics in business and finance, working internationally. He co-founded an investment firm working with companies in multiple geographies. He then used that experience to help small and entrepreneurial British companies grow. “

One must assume that the investment firm was not registered in the UK.

      (seen on companycheck.co.uk). But there’s a weird thing with that… and perhaps it answers how Mr Cummings rose and gained such a lofty position…
      His KLUTE business partner has had over 3,000 directorships and resigned from them…

      I’m sure HMRC would find Yomtov, Keyser Sozee, Beelzebub and/or the Devil inside IR35. But Dominic won’t be.

      • He’s probably an Accountant. You use to have to have two directors to set up a company. So one’s Accountant would be the other Director and he would resign immnediately.
