Terminated Early – Anna
Anna tells us her client terminated her early from her contract and asks our advice.
I‘m not sure if you can help or not but I have an issue.
I’ve just had my contract terminated slightly early due to cuts.
My contract says 14 days after they give notice.
They called me yesterday and only sent me the termination letter today.
I say it should be 14 days from today but they are saying no.
It‘s also not specified anywhere on the contract that it‘s 14 calendar days.
Can you offer any advice please or where I could go for help?

It depends what it says in the contract. As far as they are concerned they gave you notice yesterday. However, you say as you only got the letter today you think it should be 14 days from today.
If it says that they must give notice in writing and it would start from when you receive it, then you are right.
If not, then they are right.
A contract can be verbal as well as written and the termination of a contract can be verbal as well.
Contact Complied With?
Even if it says in your contract that you must receive written notice of the termination it would also have to say that termination commences when you received the notice.

After all, they complied with that clause by sending you the written notice of a contract that they terminated the day before verbally.
As regards the 14 days not being stated as calendar days in the contract, that is implicit unless it is stated that it is 14 working days.
I‘m sorry I wasn‘t able to give you the answer that you wanted but it looks as if the firm are legally in the right.
